1. GENERAL PROVISIONS

This document establishes the Terms and Conditions of use of the website sifo.ro (hereinafter "the Site") and the conditions for purchasing products marketed through it.
The sifo.ro website is owned and administered by EMCAES FOODIE SRL, a Romanian legal entity, with its registered office in Brașov Municipality, Str. Zaharia Stancu nr. 6 B, Ap. 202, Brașov County, registered with the Trade Registry, having CUI 46998422 (hereinafter "the Seller" or "Sifo").

By browsing the Site or placing an order, the User / Buyer agrees to these Terms and Conditions. Please read this document carefully.

2. DEFINITIONS

Buyer: any natural person over 18 years of age or legal entity that creates an Account on the Site and places an Order.
User: any natural person over 18 years of age who accesses the Site.
Products: any goods marketed on the Site (mainly beer), to be supplied to the Buyer as a result of the concluded Contract.
Order: an electronic document that serves as communication between the Seller and the Buyer, through which the Buyer conveys to the Seller their intention to purchase Products from the Site.
Contract: represents the distance contract concluded between the Seller and the Buyer, without the simultaneous physical presence of the Seller and the Buyer.

3. LEGAL AGE (MINORS PROHIBITED)

ATTENTION! According to current legislation in Romania, the sale of alcoholic beverages to minors is strictly prohibited.
By accessing this Site and/or placing an Order for products containing alcohol, the Buyer declares on their own responsibility that they are at least 18 years of legal age at the time of access / placing the order.
The Seller reserves the right to cancel any order if they have reasonable suspicions that the User/Buyer is a minor. Additionally, courier companies may request presentation of an identity document at the time of package delivery to verify the recipient's age.

4. ONLINE SALES POLICY

Access to place an Order is permitted to any Buyer over 18 years of age.
Sifo reserves the right to restrict the Buyer's access to placing an Order and/or to some payment methods accepted, if it considers that based on the Buyer's conduct or activity on the Site, their actions could prejudice the Seller in any way.

5. PRODUCT INFORMATION AND PRICES

All information used to describe the Products available on the Site (static/dynamic images/multimedia presentations/text) do not constitute a contractual obligation from the Seller, being used exclusively for presentation purposes.
All prices corresponding to the Products presented on the Site are expressed in Romanian lei (RON) and include VAT according to current legislation.
Prices may be modified by the Seller at any time without notice, however the price valid for the placed Order is the one displayed at the time of Order finalization.

6. ORDER AND PAYMENT METHODS

The Buyer can place Orders on the Site by adding desired Products to the shopping cart, followed by Order finalization and payment.
By finalizing the Order, the Buyer consents that all data provided by them, necessary for the purchasing process, are correct, complete, and true.
Order payment is made exclusively online, by bank card, through an authorized payment processor. Sifo does not store your complete bank card data. After placing the order, you will be redirected to the secure platform of the payment processor to enter the necessary data to complete the transaction.

7. PRODUCT DELIVERY

Product delivery is made through a partner courier company, only within Romania.
Cost and delivery time: Since we collaborate with external courier companies, the exact delivery cost and estimated transit time will be clearly displayed in the shopping cart before Order finalization, and may vary depending on destination, package weight, and courier policies at the time of shipping.
The Seller will ensure proper packaging of Products and will transmit accompanying documents.
Upon receiving the package, please check the integrity of packaging and bottles. If you notice broken bottles or severely damaged packages, you have the right to refuse receipt and contact us immediately at bere@sifo.ro.

8. RETURN POLICY AND RIGHT OF WITHDRAWAL

According to O.U.G. no. 34/2014 regarding consumer rights in contracts concluded with professionals, the Buyer has the right to withdraw from the Contract, meaning to return a Product, within 14 calendar days from the day the Buyer (or a third party indicated by them) takes physical possession of the products, without invoking any reason and without bearing other costs than delivery costs for return.

Return conditions for alcoholic beverages (Sifo Beer):

Products can be returned only if they are sealed (cap unopened), in original packaging, with all labels intact and without signs of consumption, wear, or damage. For hygiene and food safety reasons, opened bottles cannot be returned.
The direct cost of returning products (courier fee for return) will be borne by the Buyer, except in cases where the return is caused by our error (wrong product, damaged product). The courier company used for return can be chosen by the Buyer, or can be the one we collaborate with (exact details will be established at the time of request).

To exercise your right of withdrawal, you must inform us of your decision at the email address: bere@sifo.ro.
We will refund the value of returned Products within a maximum of 14 days from the date we are informed of your decision to withdraw from the Contract, but not earlier than receiving the returned Products, using the same payment method (bank card) as for the initial purchase.

9. LIABILITY

The Seller cannot be held responsible for any damages of any kind that the Buyer or any third party may suffer as a result of the Seller fulfilling any of its obligations according to the Order, nor for damages resulting from the use of Products after delivery (including irresponsible alcohol consumption).
We recommend moderate and responsible alcohol consumption.

10. FORCE MAJEURE

Neither party will be responsible for non-performance of its contractual obligations if such non-performance is due to a force majeure event, as defined by Romanian law.

11. PERSONAL DATA PROCESSING (GDPR)

By placing an order or using the site, you agree to the processing of your personal data for the purpose of processing orders, issuing invoices, delivery, and support. We collect only strictly necessary data (name, delivery/billing address, phone, email). Sifo commits to respecting data confidentiality according to provisions of Regulation (EU) 2016/679 (GDPR).

12. APPLICABLE LAW AND DISPUTE RESOLUTION

This document is subject to Romanian law. Any disputes arising between the Seller and Users/Buyers will be resolved amicably or, if this is not possible, disputes will be resolved by Romanian courts competent in Brașov Municipality.
